Birthday Voucher
Receive a treat on your birthday exclusively via Bosworth’s Loyalty App.  The reward is shown as a voucher on the App.   To qualify you need to have spent £1 or more within the 12 months prior to your Birthday month and have presented your card at the time of purchases to register these to your account. . Voucher only valid for the dates shown on the voucher.  Not exchangeable for cash.  Can only be used in one transaction.  Our current offer is £10 to spend in store or in the cafe's.  To receive the voucher, please ensure you enter your date of birth by visiting the “Your Profile” section in the app.  We regret we cannot issue a birthday voucher outside of your birthday month and are only available through the Bosworth’s Loyalty App.  Exclusions apply - cannot be used for the purchase of alcohol, gift vouchers or fuel.  If your purchase is below £10 we regret that no change will be given.   Can be used on any day of the week including weekends.

By joining our Loyalty Card Programme you will be added to our eNewsletter database and receive our eNewsletter approximately once a month.  These contain our latest news, events, and offers.   You can unsubscribe anytime.  We use Garden Connect (Green Solutions) or Klaviyo to provide you with our eNewletter.  Outside of this we do not share your information with any other third party.

Terms and Conditions
1. Introduction
a. The Loyalty Card programme rewards members with points redeemable as vouchers when they make qualifying purchases at Bosworth’s Garden Centre at Elton and Burton Latimer along with Mulberry and Aspen Café.
b. These terms and conditions set out the terms on which you can join the programme, earn points and convert these points into reward vouchers to spend at Bosworth’s Garden Centre. These are also the terms relating to data protection.
c. If you join the programme or use a Loyalty Card, it is deemed that you accept these Conditions.

2. Joining the Programme and using your Card
a. Your name, full postal address, email address,  must be provided for a Card to be registered. You may also add your birthday to be eligible for the Birthday Reward. Applicants must be aged 16 or over and must have a resident UK address. Bosworth’s Garden Centre reserves the right to refuse an application at its sole discretion.
b. Your Card is issued by, and remains the property of, Bosworth’s Garden Centre. It must be returned to Bosworth’s Garden Centre on request or destroyed when no longer valid for use.  New signups are via Bosworth’s Loyalty App only and plastic cards are no longer issued.
c. If Bosworth’s Garden Centre reasonably believes that you have breached these Conditions and/or abused the Loyalty Card Programme, Cards may be terminated without prior notice. The Programme reserves the right to take any action deemed necessary where a Card is found to have been used in a way that abuses the Programme.
d. Bosworth’s Garden Centre also reserves the right to: (a) stop issuing Cards at any time; (b) on notice to you, alter or amend these Conditions of operation of the Card and/or Programme; and (c) on notice to you, amend, withdraw or cancel the Cards and/or the points (including the value, redemption and issue of such) and/or terminate the Programme. In particular, we may close your account if sufficient points have not been earned to qualify for the issuance of vouchers for 12 months or if the Card has not been used for a period of 12 months or more.
e. You may terminate your Card at any time in which case all points on the Card and vouchers issued shall be lost.
f. You are responsible for the security of your Card and all vouchers issued on that Card. If you believe an unauthorised person has compromised the security of the Card by, for example, its theft or the theft of personal information relating to it you should notify Bosworth’s Garden Centre immediately. Lost, damaged or stolen Cards are no longer replaced with replacement plastic cards.  All new cards are digital only. A Card and vouchers issued should be treated like cash. The Programme is not responsible for any unauthorised use of the Card or any lost or stolen vouchers.
h. Any Card issued is personal to the person whose personal details were submitted with their registration. A Card and any points on it are non-transferable, and can only be used by the registered cardholder.
i. Only one membership per person. We reserve the right to refuse, merge or close additional accounts at any time.
j. Please keep us informed of any changes of address or email address. To update your details, please  update within Bosworth’s Loyalty App or call at our information desk, or call us on 01536 722635
k. The Programme is not open to employees of Bosworth’s Garden Centre.

3. Points and reward vouchers
a. To collect points at Bosworth’s Garden Centre, you must present your Card at the till at the time of purchase or within 30 days of the date of purchase. In the case of the latter, proof of purchase, using a validated till receipt, will be required for the points to be credited to the Card. You cannot claim points on purchases made before you joined the Programme.
b. Points will be awarded on all merchandise sold in Bosworth’s Garden Centre at Elton and Burton Latimer, and also at Mulberry and Aspen Café with the exception of gift vouchers, garden buildings, onsite concessions (Panache Pools), work through Bosworth's Landscaping, fuel(gas, wood, coal) and food stuff and drink outside of the cafe’s and other products from time to time as notified. Loyalty Card Vouchers cannot be redeemed against any promotional vouchers running at any one time.
c. Product discounts related to, and offered as part of the Programme are not valid for redemption against the excepted merchandise noted in section 3b.
d. You will receive points on qualifying transactions in centre. Points are awarded at a rate of 2.5 points for every £1.00 spent. These rates can be altered at the Programme’s discretion on reasonable notice. The Programme reserves the right to give such notice via post, email or our website. The Programme may also display notices detailing any variation to the points earning ratio instore. The number of points issued may vary between qualifying purchases.
e. The Programme reserves the right to offer bonus points on certain products as selected by Bosworth’s Garden Centre from time to time in its sole discretion.
f. The Programme reserves the right to terminate any points offers, including but not limited to such points offers referred to in sections 3e above, at its sole discretion. The programme will give Cardholders as much notice as it reasonably possible of any decision to terminate or vary any points offers. The programme reserves the right to give such notice via post, email or our website.
g. The programme reserves the right to vary the rates at any time on reasonable notice. The programme reserves the right to give such notice via post, email or our website. The Programme may also display notices detailing any variation to the points redemption value instore. All points awarded and all mailing vouchers issued have no monetary value.
h. Approximately six times a year the programme will arrange, either via its own systems or via its outsourced service providers, for you to be sent, either via email or via Bosworth’s Loyalty App the chosen means to be at the programme’s sole discretion, your vouchers corresponding to the number of points in your account at the time of the mailing extract. The mailing will only contain vouchers if you have a qualifying point’s balance of £1.00 or more. The Programme shall not be responsible for vouchers lost or bounced via email. In the future, certain rewards may be offered solely on the companies app.  Email vouchers are sent in conjunction with our Newsletter partner Garden Connect (Green Solutions) or Klaviyo.
i. The programme is entitled to vary the qualifying points balance and the number of mailings a year, from time to time at its sole discretion. The Programme will give Cardholders as much notice as it reasonably can of any variation to the qualifying points balance and/or the number of mailings a year. The Programme reserves the right to give such notice via post, email or our website.
j. When points are redeemed for vouchers carrying a specific cash discount or benefit, the voucher will have an expiry date specified on it and will be subject to any other terms and conditions stated on the voucher or otherwise publicised.

k. If the Programme reasonably suspects abuse, fraud or misconduct in respect of use of the Card, it may refuse to issue and/or cancel points or vouchers. You may not rely on any human or software error which results in the award of points or vouchers to which you are not entitled under these Conditions.
l. Vouchers are personal to you, non-transferable and cannot be exchanged for cash. They can only be used when presented with the registered Card. You may present your actual plastic card, via email or via the Bosworth’s Loyalty App. Printed email Vouchers that Bosworth’s Garden Centre deems to be damaged, defaced or photocopied will not be accepted.                                                       

m. Your Loyalty Card Cheque cannot be used against the following purchases.  Gift Vouchers (HTA or Bosworths Garden Centre), Gas or services.  

4. General Terms
a. Bosworth’s Garden Centre may vary these Conditions and will give Cardholders as much notice as it reasonably can. Bosworth’s Garden Centre reserves the right to give such notice via post, email or our website. Earning further points or using vouchers following such variation shall constitute acceptance of the changes the Scheme makes.
b. Cardholders should check our website and specifically these Conditions frequently in order to ensure they are aware of any changes that the Programme has made to these Conditions.
c. If the Programme  decides to transfer the scheme to another legal entity it may transfer all of its rights and obligations under these Conditions without your consent and may disclose information about you to any potential or new owner.
d. Bosworth’s Garden Centre will not be liable to Cardholders for losses suffered by Cardholders. This limit on liability does not exclude or limit the Programme’s liability for death or personal injury caused to a Cardholder as a result of the Programmes negligence. These Conditions prevail if they conflict with any other material issued by the Scheme to Cardholders in connection with the operation of the Programme.
e. The Programme and Cardholders rights and obligations under these Conditions and any dispute in relation to them shall be governed by English law and heard to the exclusion of all other forums in the English courts. The Scheme’s obligations to Cardholders in respect of the Programme are contained in these Conditions and nowhere else.

5. Data Protection
a. This section sets out how the Programme collects your personal data, how the Programme uses it and who the programme shares it with. Under the Data Protection Act 1998 (the “Act”), your data controller is the legal entity that operates Bosworth’s Garden Centre from which you joined the Scheme.
b. Use of your personal data (I) By joining up to the Programme and providing your personal data you agree to your name, date of birth, postal address, email address and other personal data you supply (‘personal data’) being used by Bosworth’s Garden Centre. (II) You agree to your personal data being used by the Programme and by the companies we use to help us organise and administer your application and account so that we can send you updates and information by email and/or post about the Scheme: (i) Bosworth’s Garden Centre mailings and notification of any programme changes. (ii) Marketing and promotional materials about goods and/or services on offer at Bosworth’s Garden Centre.
c. Retention: We will hold your personal data on our systems for as long as is necessary to administer your membership with the Scheme. If you cancel your registration as a member we will mark your record on our database and retain your details for administration purposes prior to deletion before the end of any period required by law.
d. Security: Your personal data shall be held and stored on our computers. The Programme confirms that it has in place adequate safety and security measures to keep your personal information safe and secure in accordance with its obligations under the Act.
e. Access to Personal Data: The Act gives you the right to access information held about you by the Scheme. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £15 to meet our costs in providing you with details of the information we hold about you.
